Joe’s Sporting Goods (“Joe’s”) offers certain discounts and promotional benefits to consumers who voluntarily provide Personal Information. These programs may constitute financial incentives under the California Consumer Privacy Act (“CCPA”). Participation is voluntary, and consumers may withdraw at any time.
Email Signup Offer
Joe’s may offer a one-time discount to consumers who enroll in Joe’s marketing email program.
A. Benefit offered
Consumers who enroll may receive a one-time promotional code for 15% off an eligible purchase. The promotional code is subject to the expiration date, product exclusions, minimum-purchase requirements, redemption limits, and other terms presented with the offer or promotional code. The code may not be combined with certain other offers and has no cash value.
B. Personal Information collected
To participate, Joe’s collects the consumer’s email address. A consumer may also voluntarily provide department, product, or shopping preferences. Joe’s uses this information to confirm enrollment, deliver the promotional code, send marketing communications, personalize communications, and measure and improve the effectiveness of its email-marketing program.
C. How to opt in
A consumer opts in by submitting their email address through the applicable enrollment form and completing any confirmation step presented by Joe’s, including confirming the email address through Joe’s double-opt-in process. Participation is not complete until the required confirmation is provided.
Birthday Offer
Consumers enrolled in Joe’s email-marketing program may voluntarily provide their birth month and day to receive a promotional offer in connection with their birthday.
A. Benefit offered
Participating consumers may receive a discount code for 16% off their next order. The birthday offer is subject to the expiration date, product exclusions, minimum-purchase requirements, redemption limits, and other terms presented with the offer. The offer may not be combined with certain other promotions and has no cash value.
B. Personal Information collected
Joe’s collects the consumer’s email address and birth month and day. Joe’s does not require the consumer’s birth year for this program. Joe’s uses the email address to identify and communicate with the participant and uses the birth month and day to determine when to provide the birthday offer.
C. How to opt in
A consumer opts in by voluntarily submitting their birth month and day through the applicable enrollment form while enrolling in, or after enrolling in, Joe’s email-marketing program. Submission of this information constitutes the consumer’s affirmative request to participate in the birthday-offer program.
Value of Consumer Personal Information
Joe’s estimates that the average value of an enrolled consumer’s email address and related program information's approximate value is reasonably related to the incentive offered.
Joe’s calculated this estimate in good faith by evaluating the revenue and profit reasonably attributable to its email-marketing program, less the expenses associated with collecting, maintaining, securing, and using program information and providing email communications and promotional benefits, and dividing the resulting value by the number of participating consumers.
Joe’s does not assign a separate monetary value to a consumer’s birth month and day. That information is used solely to determine when to provide the birthday offer. Its value is included in Joe’s overall estimate of the value of information associated with participating consumers.
The discounts and promotional benefits offered through these programs are reasonably related to the value of the Personal Information because Joe’s considers the anticipated average cost of providing the benefits—including the applicable redemption rate, average qualifying purchase, product exclusions, and related program expenses—rather than assuming that every participant will redeem every available offer. Joe’s periodically reviews the value calculation and the anticipated cost of the benefits offered.
Right to Withdraw
Participation is voluntary. A consumer may withdraw from these programs at any time by:
- selecting the unsubscribe link included in any Joe’s marketing email;
- submitting a request through Joe’s Privacy Rights Request Form; or
- contacting Joe’s at info@joessportinggoods.com or 1-888-468-6563.
Withdrawing from marketing emails will stop future marketing communications and may prevent the consumer from receiving future birthday or other email-based promotional offers. A consumer may separately request deletion of their birth month and day or other Personal Information, subject to applicable legal exceptions. Withdrawal will not affect a promotional benefit already validly issued unless the terms accompanying that benefit state otherwise.
Joe’s will not discriminate against a consumer for declining to participate or withdrawing from these programs. However, a consumer who does not provide, or asks Joe’s to delete, the information necessary to administer a program may no longer receive the benefit associated with that program.
