CALIFORNIA PRIVACY NOTICE

This California Privacy Notice supplements the Joe's Sporting Goods Privacy Policy and applies to California residents. It describes the practices of Joe's Sporting Goods ("Joe's," "we," "us," or "our") regarding the collection, use, disclosure, and sharing of Personal Information and the rights available to California residents under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the "CCPA").

Retained for as long as reasonably necessary to maintain the customer relationship, provide requested services, comply with legal and accounting obligations, resolve disputes, prevent fraud, enforce agreements, and maintain appropriate business records. Online identifiers and similar digital data are retained according to the lifespan of the applicable cookie or technology, consent settings, contractual requirements, and the operational needs for which the information was collected.

B. Personal Information Described in California Civil Code Section 1798.80(e)

Examples:
Name, address, telephone number, payment or financial information used in connection with a transaction, signatures collected upon delivery and made available to Joe’s by delivery carriers such as UPS or FedEx, employment information submitted through an employment application, and other customer-record information covered by California Civil Code section 1798.80(e).

Purposes for collection and use:
To process purchases, payments, returns, refunds, warranties, and other transactions; provide customer service; maintain customer and business records; administer employment applications; prevent fraud; and comply with legal obligations.

Sold or shared:
No, except to the extent information within this category also qualifies as an identifier or another category identified in this list as sold or shared.

Retention period or criteria:
Transaction and customer-service records are retained for the period reasonably necessary to complete the transaction, administer warranties and returns, maintain accurate business and accounting records, comply with tax and other legal obligations, resolve disputes, and prevent fraud. Applicant information is retained according to applicable employment-record requirements and Joe’s recruiting and record-retention practices.

C. Commercial Information

Examples:
Products or services purchased, obtained, viewed, considered, returned, or exchanged; shopping-cart activity; purchase history; transaction history; product interests; and purchasing tendencies.

Purposes for collection and use:
To process and fulfill purchases, returns, and exchanges; provide customer service; administer loyalty, promotional, and warranty programs; personalize shopping experiences; conduct analytics; improve products and services; and support advertising and marketing.

Sold or shared:
Yes. Certain commercial information may be sold or shared with advertising and marketing partners and advertising platforms for cross-context behavioral advertising.

Retention period or criteria:
Transaction records are retained for as long as reasonably necessary to fulfill orders, process returns and warranties, maintain customer and accounting records, comply with tax and other legal obligations, resolve disputes, prevent fraud, and enforce agreements. Product-viewing and shopping-interaction information is retained based on the lifespan of the applicable cookie or technology, consent settings, contractual requirements, and applicable business needs.

Browsing history, search history, interactions with Joe’s websites, applications, emails, advertisements, and online services; referring URLs; pages viewed; links clicked; device and browser information; and cookie or pixel data.

To operate and secure Joe’s websites and online services; remember preferences; troubleshoot technical issues; measure website and advertising performance; conduct analytics; personalize content; prevent fraud; and support advertising and marketing.

Sold or shared:
Yes. Certain internet or electronic network activity may be sold or shared with advertising networks, analytics providers, advertising and marketing partners, and social media platforms for cross-context behavioral advertising.

Retention period or criteria:
Retained according to the lifespan of the applicable cookie or similar technology, the consumer’s consent and privacy settings, contractual requirements, security needs, and the period reasonably necessary for analytics, troubleshooting, fraud prevention, advertising measurement, and other disclosed purposes.

E. Geolocation Data

Examples:
Approximate location derived from an IP address and location information provided in a shipping, billing, or pickup address.

Purposes for collection and use:
To identify the appropriate store or service area; calculate shipping, taxes, and availability; fulfill and deliver orders; prevent fraud; conduct analytics; and provide location-relevant content or advertising.

Sold or shared:
Yes. Approximate geolocation derived from an IP address may be sold or shared with advertising, analytics, and marketing partners for cross-context behavioral advertising. Joe’s does not sell or share precise geolocation information.

Retention period or criteria:
Address information is retained with the related transaction or customer record for as long as reasonably necessary to fulfill orders, provide services, prevent fraud, comply with legal and accounting obligations, and resolve disputes. Approximate geolocation derived from online activity is retained according to the lifespan of the applicable cookie or technology, consent settings, contractual requirements, and applicable business needs.

F. Audio, Electronic, Visual, Thermal, Olfactory, or Similar Information

Examples:
Security camera footage, photographs, videos, or other audio or visual information provided to or collected by Joe’s.

Purposes for collection and use:
To provide customer service; document communications; investigate incidents; maintain store and information security; prevent theft and fraud; resolve disputes; and comply with legal obligations.

Sold or shared:
No.

Retention period or criteria:
Customer-service recordings and submitted media are retained for as long as reasonably necessary to address the inquiry, document the interaction, train personnel, resolve disputes, and comply with legal obligations. Security footage is generally retained for a limited period unless it is needed to investigate an incident, preserve evidence, address a legal claim, or comply with law.

G. Professional or Employment-Related Information

Examples:
Employment history, education, qualifications, résumé information, references, availability, and other information submitted through an online job application.

Purposes for collection and use:
To evaluate applicants; communicate about employment opportunities; conduct permitted background and reference checks; administer recruiting and hiring; maintain employment records; and comply with legal obligations.

Sold or shared:
No.

Retention period or criteria:
Retained for the period reasonably necessary to administer the application and hiring process, consider the applicant for current or future positions where appropriate, establish or defend legal claims, and satisfy applicable employment and recordkeeping requirements.

H. Inferences Drawn from Personal Information

Examples:
Inferences regarding shopping preferences, product interests, purchasing tendencies, likely interests, and marketing segments.

Purposes for collection and use:
To personalize website experiences and communications; recommend products; understand customer preferences; conduct analytics; develop marketing audiences; measure advertising; and improve products and services.

Sold or shared:
Yes. Certain inferences may be sold or shared with advertising and marketing partners and advertising platforms for cross-context behavioral advertising.

Retention period or criteria:
Retained for as long as reasonably necessary to support the marketing, personalization, analytics, and customer-service purposes for which the inference was created. Retention also depends on the continued accuracy and usefulness of the inference, the lifespan of associated identifiers, consent settings, contractual requirements, and applicable legal obligations.

I. Sensitive Personal Information

Examples:
Account log-in information in combination with credentials allowing access to an account, and financial account, debit-card, or credit-card information in combination with any required security or access code, or credentials allowing access to an account.

Purposes for collection and use:
To authenticate customer accounts; process and secure payments and transactions; detect and prevent fraud; protect customer and business information; provide requested goods and services; and comply with legal obligations.

Sold or shared:
No. Joe’s does not sell or share Sensitive Personal Information and does not use or disclose it for purposes that give rise to a right to limit under the CCPA.

Retention period or criteria:
Account credentials are retained for as long as the account remains active or as reasonably necessary to secure the account, prevent fraud, resolve disputes, and comply with law. Payment credentials are retained only as necessary to process and secure transactions and according to payment-card, legal, contractual, and fraud-prevention requirements.

Personal Information We Collect

We do not collect or use Personal Information for purposes that are incompatible with the purposes described above without providing any notice or obtaining any consent required by applicable law.

Sale or Sharing of Personal Information

As identified in the table above, Joe’s may sell or share certain categories of Personal Information for cross-context behavioral advertising as those terms are defined under the CCPA. Joe’s does not sell Personal Information in exchange for monetary payment.

California consumers may opt out of the sale or sharing of their Personal Information by using our Your Privacy Choices link.

Joe’s recognizes and processes qualifying opt-out preference signals, including Global Privacy Control (GPC), as requests to opt out of the sale or sharing of Personal Information.

Retention of Personal Information

The specific length of time we retain Personal Information varies depending on the nature of the information and the purposes for which it was collected and used. We consider factors including the length of our relationship with the consumer, the need to provide products and services, transaction and accounting requirements, applicable legal and regulatory obligations, fraud and security considerations, dispute resolution, and the establishment, exercise, or defense of legal claims.

We do not retain Personal Information for longer than is reasonably necessary for the disclosed purposes for which it was collected.

Joe's does not sell Personal Information in exchange for monetary payment. However, some disclosures of Personal Information to advertising, marketing, analytics, social media, or similar technology providers may constitute "selling" or "sharing" under the broad definitions contained in California law, including when information is used for cross-context behavioral advertising.

Right to Limit the Use and Disclosure of Sensitive Personal Information

Joe's uses and discloses Sensitive Personal Information only for purposes permitted under the CCPA, including as reasonably necessary and proportionate to provide requested goods and services, process and secure transactions, maintain customer accounts, prevent and investigate fraud and security incidents, and comply with applicable legal obligations.

Joe's does not use or disclose Sensitive Personal Information for purposes that give rise to a right to limit under the CCPA.

Right to Non-Discrimination

We will not discriminate against you because you exercise a privacy right provided by California law.

For example, unless otherwise permitted by law, we will not deny you goods or services, charge you different prices or rates, provide you a different level or quality of goods or services, or retaliate against you for exercising your California privacy rights.

We may derive inferences from Personal Information, such as information regarding:

Sensitive Personal Information

Depending on your interaction with Joe's, Sensitive Personal Information may include account log-in information in combination with credentials that allow access to an account, and financial account, debit card, or credit card information in combination with any required security or access code, password, or credentials permitting access to an account.

Payment information may be processed by payment processors and other service providers on our behalf. Joe's may not directly receive or retain all payment credentials provided during a transaction.

Joe’s does not use or disclose Sensitive Personal Information for the purpose of inferring characteristics about consumers or for other purposes that give rise to a right to limit under the CCPA.

Joe's does not sell Personal Information in exchange for monetary payment.

California law, however, defines "sale" and "sharing" more broadly than an exchange of information for money.

During the preceding 12 months, Joe's has disclosed certain Personal Information through online advertising and marketing technologies in circumstances that may constitute "sale" or "sharing" under California law.

These disclosures are made for purposes including cross-context behavioral advertising, advertising measurement and attribution, developing advertising audiences, and measuring the effectiveness of advertising campaigns.

8. CHILDREN'S PERSONAL INFORMATION

Joe's does not have actual knowledge that it sells or shares the Personal Information of consumers under 16 years of age.

Joe's does not knowingly collect information through its website for the purpose of determining whether a consumer is under 16 years of age. Certain promotional programs may request a consumer's birth month and day, such as to provide birthday-related offers, but Joe's does not collect the consumer's birth year through those programs.

If Joe's obtains actual knowledge that a consumer is under 16 years of age, Joe's will not sell or share that consumer's Personal Information without the affirmative authorization required by applicable law.

9. RETENTION OF PERSONAL INFORMATION

We retain Personal Information only for as long as reasonably necessary and proportionate to accomplish the purposes for which it was collected or processed, unless a longer retention period is required or permitted by law.

The applicable retention period depends upon factors including:

  • the nature and sensitivity of the information;
  • the purposes for which it was collected;
  • the duration of our relationship with the consumer;
  • transaction and warranty requirements;
  • fraud-prevention and security requirements;
  • accounting and recordkeeping requirements;

When Personal Information is no longer reasonably necessary for these purposes, we may delete, de-identify, or otherwise dispose of it in accordance with applicable requirements.

We will confirm receipt of a request to know, delete, or correct no later than 10 business days after receiving the request and will provide information about how we will process the request.

We generally will substantively respond no later than 45 calendar days after receiving the request. If reasonably necessary, we may take up to an additional 45 calendar days, for a maximum of 90 calendar days, provided that we notify you and explain why additional time is needed.

Requests to opt out of sale or sharing do not require verification. We will process a request to opt out of sale or sharing as soon as feasibly possible and no later than 15 business days after receiving the request.

We will use Personal Information provided for verification only as permitted by applicable law.

We may deny or limit a request when permitted or required by law and will provide an explanation when required.

11. AUTHORIZED AGENTS

A California resident may designate an authorized agent to submit certain privacy requests on their behalf.

We may require the authorized agent to provide proof that the consumer gave the agent signed permission to submit the request. We may also require the consumer to verify their identity directly with us or directly confirm that they provided the authorized agent permission to submit the request, except where otherwise prohibited by law.

An authorized agent may submit a request through our Privacy Rights Request Form by identifying the request as one submitted by an authorized agent and providing the requested authorization information. An authorized agent may also contact us using the email address, toll-free telephone number, or mailing address provided in Section 10.

Authorized agents must comply with applicable California requirements.

12. GLOBAL PRIVACY CONTROL AND OPT-OUT PREFERENCE SIGNALS

Joe's recognizes and processes qualifying opt-out preference signals, including Global Privacy Control (GPC), as requests to opt out of the sale or sharing of Personal Information.

Consumers may enable GPC through a browser or browser extension that supports the signal. When Joe's receives a qualifying opt-out preference signal, we apply the opt-out to the browser or device sending the signal and to any consumer profile that we associate with that browser or device. Where we can associate the signal with a known consumer account, we apply the opt-out to that account as required by applicable law.

Consumers do not need to submit a separate opt-out request through our website when a qualifying opt-out preference signal has been received and processed for the applicable browser or device.

Consumers may also exercise their right to opt out of the sale or sharing of Personal Information directly through our Your Privacy Choices mechanism.

13. COOKIES, ANALYTICS, AND ADVERTISING TECHNOLOGIES

Joe's and companies that provide services to us may use cookies, pixels, tags, APIs, local storage, and similar technologies to operate our website, maintain security, remember preferences, understand website usage, measure performance, and, where permitted, provide or measure advertising.

Certain analytics and advertising technologies may transmit information such as IP address, device or browser information, online identifiers, pages viewed, products viewed, interactions with our website, referring information, and similar online activity to technology providers.

Joe’s provides California consumers with mechanisms to opt out of the sale or sharing of Personal Information associated with advertising and marketing technologies. These mechanisms include our Your Privacy Choices control and qualifying opt-out preference signals, including GPC.

California consumers may use the Your Privacy Choices link to exercise applicable rights concerning the sale or sharing of Personal Information and may also use a qualifying opt-out preference signal such as GPC.

The availability of particular technologies and privacy choices may depend upon the consumer's location, browser, device, and selections.

14. Notice of Financial Incentive

Joe’s Sporting Goods (“Joe’s”) offers certain discounts and promotional benefits to consumers who voluntarily provide Personal Information. These programs may constitute financial incentives under the California Consumer Privacy Act (“CCPA”). Participation is voluntary, and consumers may withdraw at any time.

Email Signup Offer

Joe’s may offer a one-time discount to consumers who enroll in Joe’s marketing email program.

A. Benefit offered

Consumers who enroll may receive a one-time promotional code for 15% off an eligible purchase. The promotional code is subject to the expiration date, product exclusions, minimum-purchase requirements, redemption limits, and other terms presented with the offer or promotional code. The code may not be combined with certain other offers and has no cash value.

B. Personal Information collected

To participate, Joe’s collects the consumer’s email address. A consumer may also voluntarily provide department, product, or shopping preferences. Joe’s uses this information to confirm enrollment, deliver the promotional code, send marketing communications, personalize communications, and measure and improve the effectiveness of its email-marketing program.

C. How to opt in

A consumer opts in by submitting their email address through the applicable enrollment form and completing any confirmation step presented by Joe’s, including confirming the email address through Joe’s double-opt-in process. Participation is not complete until the required confirmation is provided.

Birthday Offer

Consumers enrolled in Joe’s email-marketing program may voluntarily provide their birth month and day to receive a promotional offer in connection with their birthday.

A. Benefit offered

Participating consumers may receive a discount code for 16% off their next order. The birthday offer is subject to the expiration date, product exclusions, minimum-purchase requirements, redemption limits, and other terms presented with the offer. The offer may not be combined with certain other promotions and has no cash value.

B. Personal Information collected

Joe’s collects the consumer’s email address and birth month and day. Joe’s does not require the consumer’s birth year for this program. Joe’s uses the email address to identify and communicate with the participant and uses the birth month and day to determine when to provide the birthday offer.

C. How to opt in

A consumer opts in by voluntarily submitting their birth month and day through the applicable enrollment form while enrolling in, or after enrolling in, Joe’s email-marketing program. Submission of this information constitutes the consumer’s affirmative request to participate in the birthday-offer program.

Value of Consumer Personal Information

Joe’s estimates that the average value of an enrolled consumer’s email address and related program information's approximate value is reasonably related to the incentive offered.

Joe’s calculated this estimate in good faith by evaluating the revenue and profit reasonably attributable to its email-marketing program, less the expenses associated with collecting, maintaining, securing, and using program information and providing email communications and promotional benefits, and dividing the resulting value by the number of participating consumers.

Joe’s does not assign a separate monetary value to a consumer’s birth month and day. That information is used solely to determine when to provide the birthday offer. Its value is included in Joe’s overall estimate of the value of information associated with participating consumers.

The discounts and promotional benefits offered through these programs are reasonably related to the value of the Personal Information because Joe’s considers the anticipated average cost of providing the benefits—including the applicable redemption rate, average qualifying purchase, product exclusions, and related program expenses—rather than assuming that every participant will redeem every available offer. Joe’s periodically reviews the value calculation and the anticipated cost of the benefits offered.

Right to Withdraw

Participation is voluntary. A consumer may withdraw from these programs at any time by:

  • selecting the unsubscribe link included in any Joe’s marketing email;
  • submitting a request through Joe’s Privacy Rights Request Form; or
  • contacting Joe’s at info@joessportinggoods.com or 1-888-468-6563.

Withdrawing from marketing emails will stop future marketing communications and may prevent the consumer from receiving future birthday or other email-based promotional offers. A consumer may separately request deletion of their birth month and day or other Personal Information, subject to applicable legal exceptions. Withdrawal will not affect a promotional benefit already validly issued unless the terms accompanying that benefit state otherwise.

Joe’s will not discriminate against a consumer for declining to participate or withdrawing from these programs. However, a consumer who does not provide, or asks Joe’s to delete, the information necessary to administer a program may no longer receive the benefit associated with that program.

Joe's uses reasonable administrative, technical, and physical safeguards designed to protect Personal Information against unauthorized access, destruction, use, modification, or disclosure.

Consumers should protect their account credentials and notify us if they believe their account or Personal Information has been compromised.

16. CHANGES TO THIS CALIFORNIA PRIVACY NOTICE

We may update this California Privacy Notice periodically to reflect changes in our practices, technologies, services, or legal obligations.

When we make changes, we will update the "Last Updated" date above and provide additional notice when required by applicable law.

We review and update this Notice at least once every 12 months and whenever changes to our practices or applicable law require an update.
